| dc.description.abstract | У статті розглянуто питання гуманізації у сфері кримінального судочинства, що передбачає пріоритет вироків, не пов’язаних із позбавленням волі, над покаранням у виді позбавлення волі. Зазначено, що поява інституту пробації в зарубіжних країнах сприяла: наданню органам судової влади та іншим структурам високоякісної інформації про правопорушника; організації та здійсненню контролю та нагляду за засудженими; забезпеченню соціальної і психологічної допомоги та опіки, а також проведенню роботи з правопорушниками після звільнення; зменшенню ризику повторної злочинності; підтримці осіб, яких тримають під вартою, та допомозі в підготовці до звільнення; наданню допомоги сім’ям правопорушників; організації медіації між правопорушником та постраждалим від злочину. | |
| dc.description.abstracten | Humanization in the field of criminal justice has gained public support. This process provides for the priority of non-custodial sentences over custodial sentences. This is due to the economic impact as well as to the decreasing of the level of criminalization of convicts. Probation emerged in the first half of the 19th century as a national institute of English criminal law. The reasons for the rapidly spreading of probation are explained by the fact that it refers lies in the fact that is the humane and effective criminal law method of prevention and rehabilitation. The historical development of the institution of conditional sentencing became a natural phenomenon, the search result for new, more effective types of punishments. Today the term "probation" is used in several meanings: 1) as a concept of social work with offenders and other deviant groups; 2) as an hierarchical organizational structure 3) as a body of state power 4) as suspended sentence 5) as a specific process of execution of alternative punishment; 6) the condition in which the offender is present for a certain period of time: on probation, under probation supervysion; 7) as a connecting link between the criminal process, punishment and social work. The appearance of the institute of probation in foreign countries contributed to: the granting of judicial authorities and other structures qualitative information about the offender, organization, control and supervision of the sentenced persons, support of social and psychological assistance and care, work with the offenders after release from prison, reducing the risk of recidivism, support of persons held in custody, and assistance in preparation for release from prison, providing assistance to the families of offenders, organization of mediation between the offender and victims of crime. The importance of public participation in the process of the resocialization of offenders is emphasized. | |
