| dc.description.abstract | У статті розглянуто питання доцільності застосування заходів примусу військовослужбовцями Національної гвардії України під час несення служби з охорони громадської безпеки і порядку. На підставі здійсненого порівняльного аналізу законодавства України стосовно проблемних аспектів використання терміна «примус» у практиці несення служби підрозділами Національної гвардії України виснувано, що натепер щодо питань застосування заходів примусу Національна гвардія України керується нормативно-правовими та відомчими актами Національної поліції України. В умовах сьогодення несення служби в підрозділах Національної гвардії України вимагає від військово службовців Національної гвардії України більшої відповідальності, чіткості та професіоналізму. Для своєчасного реагування та якісного забезпечення охорони і громадської безпеки підрозділам Національної гвардії України необхідно повсякчас підвищувати свій професійний рівень та вміти самостійно приймати обґрунтовані рішення в процесі виконання службових обов’язків | |
| dc.description.abstracten | The scientific article examines the question of the expediency of using coercion during the transfer of service to maintain order and ensure public safety by servicemen of the National Guard of Ukraine. Based on a valid comparative analysis of the legislation of Ukraine regarding the problematic aspects of the use of the term «compulsion» in the practice of service by units of the National Guard of Ukraine and units of the National Police of Ukraine. It is worth emphasizing that currently the National Guard of Ukraine is guided by the regulatory and departmental acts of the National Police of Ukraine regarding the use of coercive measures In modern conditions, serving in the units of the National Guard of Ukraine requires greater responsibility, clarity and professionalism from servicemen of the National Guard of Ukraine. To respond promptly and provide high-quality protection and public safety, the units of the National Guard must always raise their professional level and be able to independently make reasonable decisions in the process of performing their official duties. The use of the term «compulsion» in the practice of public order protection by units of the National Guard of Ukraine is appropriate from several aspects: 1. Legal clarity: The term «coercion» allows you to accurately define the legal limits of the use of force during the performance of official duties. This becomes especially important in the context of human rights and democracy. 2. Ensuring public order: Coercive measures, as a last resort, may be necessary to quickly respond to situations that threaten the safety of citizens or violate public order. 3. Documentation and reporting: The use of clear terms helps to properly document the actions of departments, which is important for internal control and external audits. 4. Psychological aspect: A clear regulation and understanding of the use of coercion can contribute to the confidence of military personnel in their actions and reduce the level of stress. 5. Educational component: The use of specific legal terms contributes to the improvement of legal culture and professional training of the personnel of the National Guard. 6. International experience: The practice of using coercion by legislation is generally accepted in many countries of the world, which unifies approaches to the protection of public order and promotes international cooperation in the field of security. Thus, the use of the term «coercion» in the legislation and practice of the National Guard of Ukraine is appropriate and meets the needs of ensuring law and order and the safety of citizens | |
