dc.description.abstractРозкрито основні підходи до сучасного концепту правової безпеки та його складників. Проаналізовано й переосмислено наявні дефініції правової безпеки. Викладено авторське розуміння правової безпеки та розглянуто її сутнісні ознаки. Запропоновано поняття принципів правової безпеки, сформовано їх систему й розкрито зміст. Обґрунтовано, що правова безпека як соціальний і правовий феномен має схожу з правом природу та спільні властивості, зокрема йдеться про соціальну цінність, забезпеченість, регулятивний характер.
dc.description.abstractenThe article draws upon existing results of research on the purpose and effectiveness of law and legal regulation, as well as studies addressing issues of general, national, and legal security, in order to examine the principal approaches to the contemporary concept of legal security and its constituent elements. It is established that the conceptual foundations of legal security rest upon the recognition of the value and necessity of safeguarding law and the legal system of the state, as well as upon the understanding of the interrelationship between legal security and the systems of general (social) and national security. The study substantiates that legal security, as both a social and legal phenomenon, possesses a complex and organic nature and shares inherent characteristics with law, including social value, enforceability, and a regulatory character. The main methodological approaches to understanding legal security are identified and analyzed. In particular, the approach according to which the category of legal security is associated with an assessment of the state of the legal system, its ability to effectively function and develop. As well as the approach according to which the category of legal security is associated with an assessment of the process and result of protecting the legal system and the effectiveness of legal regulation.
