dc.description.abstractЗдійснено комплексний доктринальний і практичний аналіз цивільно-правового механізму визнання майнових прав на об’єкти інтелектуальної власності, створені військовослужбовцями під час проходження служби. Досліджено концептуальну дихотомію між трудовими і військово-службовими правовідносинами, що зумовлює неможливість застосування класичних диспозитивних презумпцій спільної власності до військових інновацій.
dc.description.abstractenThis article presents a comprehensive doctrinal and practical analysis of the civil-law mechanism for recognizing property rights to intellectual property objects created by military personnel during their service in Ukraine. In modern armed conflicts, the intellectual potential of the Armed Forces is a crucial defense factor, with military personnel constantly generating innovative solutions like AI algorithms and unmanned systems. However, the specific nature of military service, based on imperative orders and public interest, objectively excludes the application of classical dispositive presumptions of joint ownership typical for labor relations. Previously, this conceptual gap left unique defense developments unprotected and the state without de jure rights to critical inventions.
