dc.description.abstractУ статті досліджено окремі проблемні аспекти використання консультації обізнаної особи в кримінальному провадженні. Проаналізовано наукову літературу з означеного питання, розглянуто позиції провідних науковців щодо застосування спеціальних знань у кримінальному судочинстві. Наголошено на актуальності питання щодо процесуальних засад отримання консультації спеціаліста як форми застосування спеціальних знань у межах Кримінального процесуального кодексу України, яким розширено права сторін кримінального провадження в частині залучення обізнаних осіб. Акцентовано увагу на невизначеності питання розмежування функцій експерта і спеціаліста. Висловлено наукове припущення, що в окремих випадках, зокрема в розрізі забезпечення державної безпеки, залучений судовий експерт може виступати і як спеціаліст в одному кримінальному провадженні, окрім періоду призначення та проведення судової експертизи (з урахуванням дотримання слідчої таємниці), що сприятиме ефективному розслідуванню кримінальних проваджень.
dc.description.abstractenThe article examines some problematic aspects of using the advice of a knowledgeable person in criminal proceedings. The authors analyze the scientific literature on this issue and consider the positions of leading scholars on the use of specialized knowledge in criminal proceedings. The author emphasizes the relevance of the issue of the procedural basis for obtaining a specialist's advice as a form of application of specialized knowledge within the framework of the Criminal Procedure Code of Ukraine, which expands the rights of the parties to criminal proceedings in terms of involving knowledgeable persons. The author emphasizes the uncertainty of the issue of distinguishing between the functions of an expert and a specialist. The authors make a scientific assumption that in some cases, in particular in the context of ensuring state security, a forensic expert may also act in the procedural status of a specialist in the same criminal proceedings, except for the period of appointment and conduct of a forensic examination (subject to the observance of investigative secrecy), which will contribute to a more efficient investigation of criminal proceedings. The period of acquisition by a knowledgeable person of the procedural status of a forensic expert may be considered the time from the delivery of the resolution or ruling on the appointment of a forensic examination to the receipt of the expert's opinion by the customer of the examination.
