| dc.description.abstract | Вторгнення російської федерації на територію України обумовило необхідність залучення підрозділів Національної гвардії України (НГУ) до відсічі збройної агресії проти України шляхом ведення воєнних (бойових) дій, що також потягло за собою необхідність змін у їхніх структурі та забезпеченні, зокрема розвідувальному. Як зазначають дослідники, ще у 2014 р. у військових частинах оперативного призначення НГУ були створені та почали комплектуватися роти розвідки спеціального призначення, підготовка особового складу яких здійснювалася за настановами Збройних Сил України (ЗСУ) для забезпечення взаємної сумісності під час виконання завдань у єдиній системі сил оборони. Для здійснення розвідувального забезпечення підрозділів, що виконували бойові завдання, у тому ж 2014 р. Була створена ескадрилья безпілотних авіаційних комплексів та розпочалася робота щодо створення системи повітряної розвідки із застосуванням безпілотної авіаційної техніки. Проте, на думку науковців, питання існування підрозділів розвідки органів військового управління та військових частин Національної гвардії України, що в межах визначених законодавством повноважень діють з метою розвідувального забезпечення застосування НГУ, законодавчо не врегульоване належним чином і до цього часу. | |
| dc.description.abstracten | The purpose of the article is to analyze the regulatory and legal regulation of the intelligence support of the National Guard of Ukraine. In order to fulfill this goal, the following tasks are set: to investigate the legislation that regulates the activities of intelligence units and the National Guard of Ukraine; to research special literature. Both general scientific (analysis, synthesis, forecasting) and special (comparative-legal, systemic-structural, logical-legal, dogmatic) methods were used in the research process. The specificity of the National Guard of Ukraine is that it has a dual status: in peacetime, it is part of the security forces and performs law enforcement functions, as well as develops the capabilities necessary to perform tasks as part of the defense forces; with the introduction of martial law ‒ is brought into readiness to perform tasks as assigned under the conditions of the legal regime of martial law, joins the defense forces, performs tasks and is subordinate to the command of the Armed Forces of Ukraine. On the basis of the conducted analysis, a conclusion is made about the proper normalization of the activities of the intelligence units of the National Guard of Ukraine in a special period (including during the period of martial law). During this period, units of the National Guard of Ukraine may be involved by the Main Intelligence Directorate of the Ministry of Defense of Ukraine to perform military intelligence tasks and functions. In this case, the intelligence agency is the initiator of the intelligence activities, and units of the National Guard of Ukraine can conduct military intelligence at the tactical level on their own initiative. Giving the National Guard of Ukraine the powers of an intelligence agency in peacetime seems impractical, and the key to effective intelligence support during this period is to improve interaction with intelligence agencies and ways to exchange intelligence information. The prospect of further development of this direction is the study of intelligence support of units of the National Guard of Ukraine. | |
