dc.description.abstractРозроблено й обґрунтовано додатковий алгоритм короткого правового циклу для оцінювання пропорційності під час прийняття тактичного рішення командиром. Визначено його основні етапи: перевірка статусу цілі, встановлення конкретної воєнної переваги, прогноз побічної шкоди, вибір здійсненних запобіжних заходів, контроль виконання та мінімальне документування рішення командира. Доведено можливість інтеграції алгоритму у процес підготовки бою без зміни чинних процедур планування на тактичному рівні управління.
dc.description.abstractenThis article examines the specifics of tactical decision-making by commanders in combat situations through the lens of international humanitarian law, particularly the principle of proportionality. The relevance of the topic stems from the fact that modern combat operations increasingly take place in urban environments, where military targets, civilian objects, dual-use objects, and the civilian population are in close spatial proximity. Under such conditions, the commander is forced to make decisions within a limited time frame, with incomplete information, and under the influence of dynamic changes in the operational-tactical situation, which significantly complicates proper adherence to the principle of proportionality. This paper substantiates the advisability of further procedural elaboration of this principle through the introduction of a short legal cycle as a special algorithm for assessing the legality of a commanderʹs decision
